On 8 June 2026 the FDA issued Maximus Health, Inc. warning letter MARCS-CMS 730095, finding its compounded semaglutide and tirzepatide products misbranded under sections 502(a) and 502(bb) of the Federal Food, Drug, and Cosmetic Act. Two findings are cited, and both bear directly on what we praised. First, the claims 'Clinically studied ingredients', 'Clinically studied to help patients...' and 'Proven to lose weight effectively' were found to represent that the compounded products 'have been FDA-approved or otherwise evaluated for safety and effectiveness when they have not'. Second, the website described its products as sourced from 'FDA approved pharmacies' — and the FDA states plainly that compounding facilities are not 'FDA-approved' or 'FDA-licensed' entities, that no such designation exists under the FD&C Act, and that representing one as such is false and misleading. That second finding is worth noting for readers generally: we flagged the same phrasing at other providers in this directory, and the FDA has now confirmed the reasoning. Maximus was one of 30 telehealth firms warned in the sweep announced 3 March 2026.
