Summit states its THC Seltzer and Delta-9 Gummies ship to all 50 states, while Delta-8 Gummies ship to select states only, and publishes a map to check. The company's legal position is that 'all Summit products contain a concentration equal to or less than 0.3% Delta 9 THC on a dry weight basis' and are therefore federally legal under the 2018 Farm Bill. That is Summit's framing, and we would treat it as marketing. THC and alcohol have different risk profiles rather than one simply being safer: THC does not carry alcohol's liver toxicity or its withdrawal risk, but it is intoxicating, impairs driving, can trigger anxiety or panic in some people, and carries genuine risk for anyone with a personal or family history of psychosis. Cannabis use disorder is also real. At 5mg per can this is a low, controllable dose and the format is easier to gauge than a gummy — but 'smarter swap' invites you to read a comparison as an endorsement. Never combine it with alcohol, and never drive after either.
